Important: eRyde is a platform, not a transport operator
eRyde is a technology platform only. We introduce customers to independent transport providers and handle booking and payment. We do not own, operate, control, supervise, inspect, drive, insure or employ any vehicle, driver, provider or helper listed on the platform.
Every service is supplied under a contract between the customer and the provider. eRyde is not a party to that contract, is not a transport operator, carrier, freight forwarder, driving service or insurer, and is not liable or legally responsible for any incident, accident, injury, death, loss, theft, damage, delay, dispute or unlawful conduct that occurs before, during or after any service booked through the platform.
To the fullest extent permitted by South African law, all such risk and responsibility rests with the provider and the customer. Nothing in this document excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act, 68 of 2008.
1. About eRyde
eRyde ("we", "us", "our") operates an online marketplace that connects customers with independent transport providers offering carpooling, vehicle rentals, moving vans and school transport services in South Africa. eRyde is a technology platform only — we are not a transport operator and do not own, control or supervise any vehicle, driver or trip listed on the platform.
2. Acceptance of these terms
By creating an account, or by using the eRyde app or website, you confirm that you have read, understood and agree to be bound by these Terms of Use and by our Cancellation & Refund Policy. If you do not accept these terms, you may not use eRyde.
You must be at least 18 years old, legally able to enter into a binding contract, and provide accurate personal, contact and (where applicable) driver and vehicle information.
3. Roles and verification
Every eRyde account is either a customer or a provider. A provider and a driver are the same role: a provider may carpool, hire out a vehicle, offer moving-van services or run a school transport route.
All users must complete identity verification. Customers must upload a valid government-issued ID and a live selfie. Providers must additionally submit a valid driver's licence, and for each vehicle they list: the licence plate, licence disc scan, roadworthy certificate, NaTIS copy and four-angle photographs. Listings may only use vehicles that have been verified by eRyde.
When registering a vehicle, a provider must tick the box confirming that the vehicle is not registered in their name. Where that box is ticked, the provider must also upload the registered owner's ID and an affidavit or written letter of permission to use the vehicle for the services offered on eRyde. Borrowed vehicles may be used for carpooling, moving-van services and school transport only. Self-drive vehicle rentals may only be listed with a vehicle registered in the provider's own name.
You must also keep a verified email address and a verified mobile number on your account. We confirm your email address by emailed link and your mobile number by SMS one-time PIN. Until both are verified you may not request or provide any service. You may change either at any time in Account settings; a changed email address or mobile number must be re-verified, and services are paused until it is.
We may suspend, restrict or terminate any account where verification information is missing, expired, inaccurate or suspected to be fraudulent.
4. Bookings and the contract between users
When a customer books a service, a contract is formed directly between the customer and the provider for the supply of that service. eRyde facilitates the introduction, booking, payment and dispute-handling process but is not a party to that contract.
Providers must honour confirmed bookings, arrive on time, maintain their vehicle in a safe and roadworthy condition, hold valid licensing and insurance, and comply with all applicable traffic and transport regulations.
5. Payments, commission and payouts
All payments are processed online through YOCO. eRyde charges the following standard platform commissions, deducted from each booking before payout to the provider:
- Carpooling — 8%
- Vehicle rentals — 12%
- Moving vans — 15%
- School transport — 10%
A paid subscription reduces these commissions: Pro (R99/month) by 2 percentage points and Super (R199/month) by 5 percentage points on every service. Providers receive their payout, net of commission and any applicable cancellation charges, after the booking has been completed.
6. Subscriptions
eRyde offers Free, Pro (R99/month) and Super (R199/month) subscription tiers. All service categories, including school transport, are available on the Free tier. Paid tiers provide higher listing limits, lower provider commission (2% on Pro, 5% on Super) and customer discounts, and Super listings receive priority placement in search.
Subscriptions renew automatically until cancelled. Upgrades and downgrades take effect immediately and are prorated; amounts already used in the current billing cycle are non-refundable.
7. Cancellations and refunds
Cancellations, refunds and no-show charges are governed by our Cancellation & Refund Policy, which forms part of these Terms.
7A. Vehicle rentals and moving van hire
Rentals and moving van/truck hires are additionally governed by our Vehicle Rental & Moving Van Hire Terms, which form part of these Terms. Those terms set out the options the customer chooses at booking (driver or self-drive, collection or delivery, hire period, helpers and extras), deposit, mileage and fuel rules, late-return fees, how extensions are requested and approved, and who bears the cost if the vehicle breaks down, is involved in an accident, or is stolen or hijacked.
8. User conduct
You agree not to:
- impersonate another person or submit false verification documents;
- use eRyde to transport illegal goods, unaccompanied minors outside a booked school route, or persons under the influence in a way that endangers others;
- circumvent the platform to take payment off-app for bookings initiated through eRyde;
- harass, threaten, defame or discriminate against another user;
- damage, misuse or fail to return a rental or moving vehicle in the same condition (fair wear excepted).
9. Ratings, reviews and messaging
Users may leave honest ratings and reviews and communicate through in-app messaging. Content that is unlawful, defamatory, hateful or sexually explicit may be removed and may result in account termination.
10. Liability
eRyde is not liable or legally responsible for any incident that occurs during the use of any service booked through the platform. We connect drivers, providers and customers — nothing more.

To the fullest extent permitted by law, eRyde is not liable for loss, injury, damage or delay arising from the acts or omissions of any provider, driver or customer, or from the condition of any vehicle. Our aggregate liability to you for any claim relating to the platform is limited to the total commission we earned on your bookings in the three months preceding the event giving rise to the claim.
Insurance, roadworthiness, licensing, driver conduct, cargo, punctuality and the safety of every trip are the responsibility of the provider and, where applicable, the customer. Any claim arising from a trip lies between those parties and their insurers.
Nothing in these terms excludes any liability that cannot be excluded under the Consumer Protection Act, 68 of 2008 or other applicable South African law.
11. Privacy
We collect and process personal information — including identity documents, licence details, location data, trip history and payment references — to operate the platform, verify users and comply with our legal obligations. We handle personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA).
12. Suspension and termination
We may suspend or terminate your account at any time, with or without notice, if you breach these terms, fail verification, or use the platform in a way that we reasonably consider unsafe, fraudulent or harmful to other users.
13. Deactivating or deleting your account
You control your account and may pause or close it at any time from Account settings.
Temporary deactivation
- You remain signed in and may continue to browse eRyde and view services.
- You may not request any service and may not provide any service. Your listings stop accepting new bookings.
- Any active paid subscription must be cancelled by you before you deactivate. No refund is issued for the remainder of a paid period.
- You may reactivate instantly at any time, which restores full access.
- You remain responsible for bookings already confirmed before deactivation, or must cancel them under the Cancellation & Refund Policy.
Deletion
- You are signed out immediately and lose access to all services.
- Any active paid subscription must be cancelled by you before you request deletion. No refund is issued.
- Your account enters a 30-day grace period. If you sign in again within those 30 days, your account is automatically reactivated with your data intact.
- After 30 days your account and personal information are permanently and irreversibly erased from our systems, including your profile, verification documents, vehicles, listings, bookings and reviews.
- We may retain a limited set of transaction, tax and fraud-prevention records where South African law requires it, as described in our Privacy Policy.
14. Your POPIA rights
We process your personal information as a responsible party under the Protection of Personal Information Act, 4 of 2013 (POPIA). You have the right to be notified of processing, to access the personal information we hold about you, to have it corrected or deleted, to object to processing, to withdraw consent, and to complain to the Information Regulator of South Africa.
We collect only the information needed for the purposes described in these terms, keep it only as long as necessary or legally required, secure it with encryption in transit and access controls, and do not sell it. 15. Changes to these terms
We may update these terms from time to time. Material changes will be notified in-app or by email. Continued use of eRyde after the effective date constitutes acceptance of the updated terms.
16. Governing law
These terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the exclusive jurisdiction of the South African courts.
